1. Introduction

Welcome to Buzzinga.io! These Terms of Service ("Terms") govern your access to and use of our website, services, and products ("Services"), which are owned and operated by Buzzinga Games Inc. ("Buzzinga," "we," "us," or "our"). By using Buzzinga.io, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

2. Eligibility

To use Buzzinga.io, you must:

• Be at least 13 years old.
• Agree to these Terms and our Privacy Policy.
• Use the Services in compliance with applicable laws and regulations.

3. Your Account

• Account Creation: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Account Termination: Buzzinga Games Inc. reserves the right to suspend or terminate accounts that violate these Terms or our policies.
• Data Management: You may request deletion of your account and personal data as described in our Privacy Policy.

4. User Content

• Ownership: You retain ownership of the content you create and upload to Buzzinga.io.
• License to Buzzinga: By uploading content, you grant Buzzinga Games Inc. a non-exclusive, royalty-free license to host, display, reproduce, and distribute your content for the purpose of providing the Services.
• Prohibited Content: You agree not to upload or create content that violates intellectual property rights, contains harmful or illegal material, or violates these Terms.
• Content Removal: Buzzinga Games Inc. reserves the right to remove content that violates these Terms.
• Community Board Submissions: Buzzinga may offer users the option to submit boards for inclusion in a public “Community Boards” section. Submission is voluntary, and if accepted, your board may be displayed publicly and accessible to other Buzzinga users. You retain ownership of your content while granting us a license to display it in this context.

5. Paid Plans and Subscriptions

• Subscription Terms: Buzzinga Pro is offered on a subscription basis (currently $12/month or $99/year). Subscriptions will automatically renew at the end of each billing cycle unless cancelled.
• Billing and Payments: All payments are processed securely by our third-party provider, Lemon Squeezy. Buzzinga Games Inc. does not store or have access to your payment details.
• Cancellation: You may cancel your subscription at any time through your Lemon Squeezy customer portal. Deleting your Buzzinga account will not cancel your subscription.
• Feature Modifications: Subscription features may be updated, modified, or replaced with equivalent features as the platform evolves.
• Refunds: While all payments are generally non-refundable, Buzzinga Games Inc. may provide refunds on a discretionary basis when requested. To request a refund, please contact us at hello@buzzinga.io.

6. Acceptable Use Policy

You agree not to use Buzzinga.io for any unlawful purposes, to interfere with its operation, or to upload harmful material (e.g., malware or spam).

7. Intellectual Property

• Buzzinga.io Ownership: All intellectual property rights, including software, design, and trademarks, belong to Buzzinga Games Inc.
• User Contributions: You retain ownership of your content while granting us a license to use it as needed to provide the Services.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available." Buzzinga Games Inc. does not guarantee that the Services will meet your expectations or be error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Buzzinga Games Inc. is not liable for indirect, incidental, or consequential damages, including data loss or loss of profits, resulting from your use of Buzzinga.io or the Services.
